The terms of using Provv.

Who you're contracting with

Provv is operated by StackedGTM LLC ("Provv", "we", "us"), a Delaware limited liability company. By creating an account or using the service, you agree to these terms. If you're using Provv on behalf of a company, you confirm you have authority to bind that company.

What Provv does

Provv is a pre-ship buyer panel. It builds a small panel of synthetic buyers grounded in real public language about a market and runs your marketing copy past them for a directional read. It does not make performance guarantees and is not a substitute for live A/B testing or primary research.

Your account

You are responsible for keeping your credentials safe and for the activity on your account. Do not share your account or use Provv on behalf of someone without their permission. Keep the information on your account accurate.

What you put in

You keep ownership of the copy you put into Provv. By using the product you grant us a limited, non-exclusive license to process and store that copy so we can return reactions and so you can come back to it. You confirm you have the right to submit the content you put in.

Acceptable use

Do not use Provv to test illegal content, infringe anyone's IP, harass anyone, distribute malware, probe or scrape the service, or attempt to extract source data, identify private individuals, or reverse the panel for any other purpose. We may suspend or terminate accounts for material breach, non-payment, fraud or security risk, or repeated policy violations.

Our IP

Provv, including the software, panels, models, documentation, and branding, is owned by StackedGTM LLC. You get a limited, non-transferable right to use it within your plan. No reverse engineering, resale, or circumvention of plan limits.

Payments and billing

Subscription payments are processed by Stripe, our payment provider. For eligible transactions, Stripe acts as the Merchant of Record and handles tax compliance, billing receipts, and chargeback processing on our behalf. Payment, billing, tax, cancellation, and refund mechanics are governed by Stripe's terms, available at stripe.com/legal/consumer. Subscriptions renew on the cycle you selected until cancelled. Availability and warranties

We work to keep Provv available and accurate, but the service is provided "as is" without warranties of any kind, including implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free performance.

Liability

To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid in the twelve months before the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these terms limits liability for fraud, death, or personal injury where the law forbids that limit.

Indemnity

You agree to indemnify StackedGTM LLC against claims arising from your content, your unlawful use of the service, or your breach of these terms.

Suspension and termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated policy violations. You can terminate by cancelling your subscription and deleting your account. On termination we will return or delete your data on request.

Governing law

These terms are governed by the laws of the State of Delaware, USA, and disputes will be brought in the state or federal courts located in Delaware.

Changes

We may update these terms; substantive changes will be flagged in product. Continued use after a change means you accept the updated terms.
